The Maryland Senate Bill 838 is sponsored by Senator Frosh. The proponents of the Bill include the Maryland Consumer Right's Coalition, who is and has been pursuing debt collection and debt buying industries. The proponents believe that hundreds of thousands of "sewer serves" are being conducted by Professional Process Serving Companies. However, they have not been able to quantify their figure, nor have provided any factual data for their basis of this assertation. They are utilizing NEW YORK as a primary source for licensing.
Although this legislation does not include businesses, the Bill includes inferences to businesses. In addition, the Bill designates all authority and discretion to he the Maryland State Troopers. (State Police). There are bonding requirements and heavy civil fines, and criminal fines.
House Bill 1293 is sponsored by SEVEN (7) House Delegates. MAAPPS has helped to develop this bill. It pertains to individual process servers who serve process in the State. It provides that the Department of Labor, License and Regulation (DLLR) be approinted the Agency, and requires them to utilize the Maryland Judiciary, to develop standards of conduct and provisions for appropriate service of process, to which individuals who serve process must adhere to. It limits the authority of DLLR. DLLR has the authority to deny or revoke, but on specific issues as it relates to the standards of conduct and laws regarding service of process in Maryland. MAAPPS utilized Standards of Conduct comparable to its Code of Ethics.
